PRIVACY INFORMATION NOTICE CV SUBMISSION AND PERSONNEL SELECTION
Pursuant to and for the purposes of article 13, Legislative Decree no. 196/2003: the personal data you have voluntarily provided in order to formalise your candidacy, by submitting your CV and/or personal, and possibly sensitive, data with a view to possible recruitment by CANALI S.p.A. single member company and the companies in CANALI S.P.A. single member company Group, will be subject to processing, also by means of IT and online data base procedures. For the purposes of selecting professional human resources, CANALI S.P.A single member company asks interested parties to provide all the data which may be useful in determining their suitability to hold positions in the company and to submit their own spontaneous candidacy. CANALI S.P.A single member company undertakes to use the information received in compliance with the law as it stands and, in particular, with provisions to protect the confidentiality of personal data. In this regard, pursuant to the specific provisions of Legislative Decree 196/03, the Company invites you to take note of the following.
Cookies The software applications used may contain “cookie” technology. The main function of cookies is to aid user navigation. Cookies can provide information about Site navigation and make it possible to offer several services which require information about the sequence of Site pages the user has visited. The cookies in the software applications used are anonymous and cannot be linked to users’ personal data. The following data is recorded every time the portal is accessed, independently of whether or not any cookies are present: the type of browser (e.g. Internet Explorer, Netscape), the operating system (e.g. Macintosh, Windows), the visitor’s host and URL, and the page requested. Purposes of processing Purposes of: personnel recruitment, possible establishment of a contractual relationship, training courses, internships at our company and companies in our Group. CANALI S.P.A single member company may, for personnel selection purposes, request CVs and all other identification and personal data of use in determining whether or not the candidate’s professional profile is in line with the needs of CANALI S.P.A. single member company, which reserves the right to remove the data received from its archive in the event that same, when checked, is inexact, incomplete or not up-to-date, and may also ask for further data to be supplied to provide information about the candidate’s initiatives and activities. CANALI S.P.A. single member company may use the data provided for statistical reasons in relation to such purposes, while maintaining the anonymity of the interested party. So-called sensitive and/or legal data may also be subject to processing and communication.
Sensitive data In the event the information provided to CANALI S.P.A. single member company contains sensitive data (i.e. which reveals race and ethnicity; religious, philosophical and other beliefs; political opinions; membership of political parties, trade unions and religious, philosophical, political or trade union associations; as well as information such as to reveal state of health and sexual life), such data may be processed only with the express written consent of the interested party. In the event of sensitive data communication, the interested party authorises processing of same.
Method of processing and Storage Processing will be automatic and/or manual, using methods and tools designed to ensure the utmost security and confidentiality, by parties engaged specifically for this purpose in compliance with the provisions of article 31 and subsequent, Legislative Decree 196/03. The data will be retained for no longer than is strictly necessary in relation to the purposes for which the data was collected and subsequently processed. CANALI S.P.A. single member company will make provision with regard to the data received for: 1) the precise registration of same to ensure that it corresponds to the declarations of the interested party; 2) updating such data as a result of change notifications received from interested parties.
Scope of communication and diffusion Your personal data, as processed, will not be subject to diffusion but may be transmitted to companies associated with CANALI S.P.A. single member company, to foreign companies in the European Union in compliance with and within the limits of article 42, Legislative Decree no. 196/2003. The personal data may also be transferred to foreign countries outside the EU in the framework and within the limits provided by article 43 and article 44, letter b), Legislative Decree no. 196/2003, with your consent. The data may be communicated to third parties in the following categories and if required by law. Therefore, your personal and identification data will be communicated to, amongst others; - the personnel selection and information system management area employees so tasked by our company; - associated companies; - CareerBuilder Italy; - firms and companies in the framework of assistance and consulting operations. Parties in the aforementioned categories perform the function of Data Processor or operate in full independence as individual Data Controllers. The list of any data processors is constantly updated and available for consultation at the head office of CANALI S.P.A. single member company. Any other communication or diffusion will be performed only after receiving your explicit consent.
Nature of data provision and denial of consent The provision of your data is optional, but refusal to reply or grant consent may make it impossible for the Data Controller to follow up your requests as a candidate. You may exercise your rights as set forth in articles 7, 8, 9 and 10, Legislative Decree no. 196, 30 June 2003, by contacting the Data Controller (or the personnel data processing manager).
Article 7. Right of access to personal data and other rights 1. Interested parties have the right to receive confirmation of whether or not personal data is held regarding them, even if such data has not yet been registered, and the transmission of same in intelligible form. 2. Interest parties have the right to obtain information regarding: a) the origin of the personal data; b) the purposes and methods of processing; c) the logic applied in the event of processing performed with the aid of electronic tools; d) the identity of the data controller, the data processor and the designated representative pursuant to article 5, section 2; e) parties and categories of parties to whom the personal data may be communicated or who may gain knowledge of same in their capacity as designated representative in the territory of the State, as data processors or as persons in charge of processing. 3. Interested parties have the right to obtain: a) the updating, correction and addition of data if of interest; b) the cancellation, anonymisation or blocking of data processed in breach of the law, including data which does not have to be retained in relation to the purposes for which the data was collected or subsequently processed; c) certification that the operations set forth under letters a) and b), including their content, have been notified to the parties to whom the data has been communicated or diffused, with the exception of the case in which such obligation is impossible to discharge or requires an effort that is manifestly disproportionate to the right protected. 4. Interested parties have the right to object entirely or in part: a) to the processing of their personal data, for legitimate reasons, even though such data is pertinent to the purpose of collection; b) to the processing of personal data regarding same for the purpose of sending advertising or direct marketing material, or for the purpose of market research and commercial communication. In relation to the aforementioned processing, the data subject has the right at any time to receive confirmation of whether or not such data exists and to be informed of its content and source, to verify its accuracy or request that it be supplemented, updated or rectified pursuant to article 7, Legislative Decree no. 196/2003. Pursuant to the same article, the data subject has the right to request the cancellation, transformation into anonymous form or blocking of his/her data, even though same is pertinent to the purposes of the collection or of sending advertising or direct mailing materials, or in order to perform market surveys or send commercial information.
